Motions filed in Ballard case

WICKLIFFE, Ky. — The defense filed two motions during a pretrial conference in Ballard Circuit Court in the animal torture case against a man accused of feeding dogs meat soaked in antifreeze.
Edward Ream, 67, of Barlow, was indicted March 11 on three counts of torture of a dog or cat, two counts of attempted torture of a dog or cat, two counts of first-degree criminal mischief and four counts of second-degree criminal mischief.
Ream was originally cited on Feb. 6 after county authorities searched his North Adkins Road residence and found containers of food soaking in what they believed to be antifreeze.
County animal control officers said four containers were found on the property as well as a half-empty gallon of antifreeze. The search was prompted by an anonymous tip, according to animal control officer James Campbell.
On Friday, Ream's attorney Jeremy Ian Smith filed a motion to dismiss five of the 11 charges on the grounds that they stem from incidents that fall outside the misdemeanor statute of limitations.
The statute of limitations for misdemeanor charges is one year, according Kentucky Revised Statute 500.050.
According to the motion, one charge of first-degree criminal mischief and four charges of second-degree criminal mischief are alleged to have happened between 1999 and 2009.
The charges stem from incidents involving approximately four dogs and a cat, the most recent of which states Ream allegedly caused $500 or more worth of damage to a domesticated dog in November 2009.
Smith also filed a motion to suppress the evidence collected during the execution of a search warrant. In the motion, Smith states there was no probable cause to support the issuance of the warrant.
The commonwealth had not yet filed a response to the motions as of Monday evening.
The motions will be addressed during an 8:30 a.m. hearing May 8 in Ballard Circuit Court.
